Welcome to ForgeForth Africa. These Terms of Service ("Terms") govern your access to and use of our platform, services, and features. By creating an account or using our services, you agree to be bound by these Terms, our Privacy Policy, and our Cookie Policy. These Terms comply with South African law, including the Consumer Protection Act 68 of 2008 (CPA), the Electronic Communications and Transactions Act 25 of 2002 (ECTA), and POPIA.
Acceptance of Terms
By accessing or using ForgeForth Africa, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use our services.
We may update these Terms from time to time. We will notify you of material changes via email or a notice on our platform. Your continued use after changes take effect means you accept the new Terms.
Important (ECTA Section 11): This is an electronic agreement. By clicking "I Accept," "Sign Up," or similar, you are electronically signing this agreement with the same legal effect as a handwritten signature.
Eligibility
To use ForgeForth Africa, you must:

You are not prohibited from using our services under any applicable law.
All information you provide must be true, accurate, and complete.
You may only maintain one active personal account.
You agree to use our services honestly and in good faith.
Account Registration & Security
Account Creation
- You must provide accurate, current, and complete information during registration.
- You must keep your account information updated.
- We may verify your identity and credentials as part of our services.
Account Security
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must notify us immediately of any unauthorized access or security breach.

Note: We do not guarantee employment or opportunities. We are a platform that facilitates connections between talent and organizations.

Content & Intellectual Property
Your Content
You retain ownership of content you upload. By uploading, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and share your content as necessary to provide our services.
You are solely responsible for your content and must ensure it does not infringe on any third-party rights.
Our Content
ForgeForth Africa owns all rights to our platform, branding, software, algorithms, and original content. You may not copy, modify, distribute, or create derivative works without our written permission.
All trademarks, logos, and service marks are the property of ForgeForth Africa (Pty) Ltd.
Payments & Fees
ForgeForth Africa offers both free and premium services:
Free Services
Basic profile creation, opportunity browsing, and limited matching features are available at no cost.
Premium Services
Enhanced features, verification services, and priority matching may be subject to fees. All prices are displayed in South African Rand (ZAR) and include VAT where applicable.
Consumer Protection (CPA Section 14): You have the right to cancel direct marketing agreements within 5 business days without penalty.
Termination
By You
You may close your account at any time by contacting us or using the account settings. Upon termination, your access to our services will cease.
By Us
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with notice.
Effect of Termination
Upon termination, your right to use our services immediately ceases. We may retain certain data as required by law or for legitimate business purposes, in accordance with our Privacy Policy.
Disclaimers
"As Is" Basis
Our services are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law.
No Employment Guarantee
We do not guarantee that you will receive job offers, opportunities, or any specific outcomes from using our platform.
Third-Party Content
We are not responsible for the accuracy, legality, or appropriateness of third-party content, including employer postings and user-generated content.
Service Availability
We do not guarantee uninterrupted, secure, or error-free operation of our platform.
Limitation of Liability
To the maximum extent permitted by South African law, including the CPA:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or R1,000, whichever is greater.
- These limitations do not affect your statutory rights under the CPA or other applicable consumer protection laws.
Disputes & Governing Law
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.
Dispute Resolution
- 1 Informal Resolution: We encourage you to contact us first to resolve any disputes amicably.
- 2 Mediation: If informal resolution fails, disputes may be submitted to mediation under the rules of the Arbitration Foundation of Southern Africa (AFSA).
- 3 Legal Action: Either party may pursue legal remedies in the courts of South Africa, Gauteng Division, Johannesburg.
Consumer Rights: Nothing in these Terms limits your rights to lodge complaints with the National Consumer Commission or pursue remedies under the Consumer Protection Act.
